Briefly mention the fredom of Press and Indian Constitution of 26th January 1950 ? |
The Freedom of Press and the Indian Constitution, 26th January 1950 : (a) Article 19 of the Constitution of India which came into force on 26th January 1950, provided the freedom of expression. However, it was found from experience that the right to freedom of expression was held by some courts to be so comprehensive that no action could be taken against any individual who advocated murder and other violent crimes. (b) Consequently, the Constitution (first Amendment ) Act was passed in June 1951. It was provided that the right to freedom of speech was to be subject to all laws imposing restrictions with regard to the security of the State, friendly relations with foreign States, public order, decency or morality, contempt of court, defamation and incitement to offences. |
